General conditions

Any order placed on via-vinum.com supposes the prior and unrestricted acceptance of these General Conditions of Sale, subject to French law. The fact for the user to check the box: "Please check this box to confirm that you are of legal age and to approve the General Conditions of Sale." means that he has read and accepted these general conditions. Failing to tick the box provided for this purpose, the customer will not be able to place an order. In the event of a conflict between you and our company following an order placed on via-vinum.eu, and in the event of failure of an amicable resolution, the competent court is the Commercial Court of Bordeaux (Tribunal de Commerce de Bordeaux, Gironde, France).


I - Registration to our website

  1. The sale of alcohol is prohibited for minors. When you place an order you certify that you are of legal age (+18 years in France).
  2. The data communicated during the creation of the account will not be sold or exchanged with third parties.
  3. In accordance with the current general data protection regulations (GDPR 2016/679), you have a panel on the home page of your account allowing you to view and delete your data.




II - Purchase of available wines on via-vinum.eu

All the wines offered online are sold by VIA VINUM LES VINS DE SAINT-JULIEN wine merchant in Saint-Julien Beychevelle and are stored:

  1. In our thermoregulated cellars of Saint-Julien Beychevelle (6 rue des Platanes, 33250 Saint-Julien Beychevelle).
  2. In our thermoregulated cellars of Saint-Loubès (M.E.T 12 Rue des Bruyères, 33450 Saint-Loubès).
  3. In the cellars of the estate (in case of agreement with an estate on the sale of deliverable wines shipped from their stock).


Registration of an order in our system:

  1. An order is recorded when the order process is completed (after payment has been settled).


Validation of an order:

  1. An order is validated as soon as our team prepares the order. In the event of a problem with one of the items announced in Part V, we reserve the right to cancel an order and not to confirm it, in which case, the buyer will be reimbursed immediately and in full.


Cancel an order before the departure of the wines:

  1. If you made a mistake when registering an order, or if you want to cancel an order, it is possible, in which case you must promptly notify us so that we can reimburse you immediately.


Specific addition in the event of a pandemic (Addition of 3/16/2020)

  1. By validating an order during the period of a pandemic, I understand and accept that it will only be dispatched at the end of this pandemic to the seller, VIA VINUM Eurl Les Vins de Saint-Julien, and to the delivery address that I indicate when placing an order.
  2. The times before shipment are therefore not known, and by validating an order with knowledge of these general conditions of sale, I accept the principle. The seller VIA VINUM Eurl undertakes to comply with these conditions, and to dispatch orders as soon as the pandemic period has ended.
  3. Or when conditions will be good if pandemic is long. (Special add of the 04/30/2020: shipping from the 11/05/2020 for covid19 pandemic)


III - Purchase of Futures on via-vinum.eu

All the wines sold en primeurs offered online are sold by VIA VINUM LES VINS DE SAINT-JULIEN wine merchant in Saint-Julien Beychevelle (33250), and provided by these ways:

  1. Directly from the property (95% of the wines offered) as an award-winning trader.
  2. Through a partner wine merchant himself direct beneficiary of the property.

Via Vinum does not sell wines before purchase. Each bottle offered is available in our stock of future wines.



Registration of an order in our system:

  1. An order is recorded when the order process is completed (after payment of the tax-free payment of wines and transport).


Validation of an order:

  1. An order is validated as soon as our team places this order on the following status "Primeurs 2018 for shipment" or "Primeurs 2018 for withdrawal" depending on the delivery method chosen. In the event of a problem with one of the items announced in Part V, we reserve the right to cancel an order and not to confirm it, in which case, the buyer will be reimbursed immediately and in full.


Cancel an order of future wines:

  1. If you made a mistake during the registration of an order, or if you wish to cancel an order, it is possible, in this case you must quickly notify us (within 14 days of the registration of the order) in order that we can reimburse you.


VAT invoicing:

1- By confirming the order of futures, you certify that you are aware that this purchase is tax free, and that you understand that the VAT on wines and transport (if applicable) will be invoiced before the delivery or shipment of the wines. The VAT regulations are only applicable in the following cases: if you collect the wines directly to our cellars that are located in Gironde - France, or if you have them delivered to a country of the European Union in which intra-community VAT is applicable. VAT will be invoiced at the current value at the time of VAT invoicing (when the wines are deliverable). Payment of VAT is a prerequisite before any shipment within the EU or any withdrawal on the spot.


Shipping / Withdrawal of Futures

  1. By confirming the order of wines sold en primeur, you certify that you are aware that this purchase of future wines will be made on the date indicated on the individual wine sheet, namely: For exemple, a 2018 futur wine will be available for withdrawal or shipment between the end 2020 and mid-2021. A 2019 futur wine will be available for withdrawal or shipment between the end 2021 and mid-2022 etc...
  2. The delivery of Futures is possible only in some countries, in one time delivery (if several wines, it will be necessary to wait until the last wine is available before the shipment of the batch), and to a single address.
  3. Invoiced delivery of future wines may be offered or invoiced depending on the areas and amounts.




IV - Delivery and receipt of orders

Shipping packages:

  1. Orders are prepared upon validation of payment. The deadlines announced are generally respected in 99.99% of the cases, on the other hand in case of problem on the availability of a wine, we will warn the buyer that an additional delay to collect the bottles will be necessary, in which case we will offer a refund if the new deadline is not suitable for the buyer.


Delivery times for orders after validation of payment:

The delivery times announced by carriers in France are:

  1. Chronopost: 24 to 48h
  2. DSV: 5 à 14 jours
To other countries:

It depend on the carrier and the country. DSV is usually between 5 days to 3 weeks, FedEx is usually between 2 days to 10 days. It can be longer depending to the duties of your country in case of a checking.


Packaging of orders:

  1. By DSV Mitjavile, delivery will be in wooden crate or original carton depending on availability and indications on the wine pages (in case of difference you will generally be notified)
  2. By all other carriers (Chronopost, DHL, FedEx ...) delivery will be in reinforced neutral cardboard (s) suitable for transporting wine. With Eureka OC/OWC, you can be delivered also in express air delivery with original wooden case or cardboard (Not available if only Eureka).


Important information about receiving packages:

  1. The buyer, by accepting these general conditions of sale, undertakes to check the condition of the package and the contents in the presence of the delivery person (if delivery to the home), or with the person responsible for the relay point (if delivery in relay point against signature) and to refuse or issue reservations on a damaged package.
  2. If you accept a damaged package without verification, without reporting to the carrier, we will not be able to make a refund because the insurance will not take charge without reservation.
  3. The delivery address indicated when placing an order is only used for home deliveries. In the case of a relay point delivery, this address will be used to select the nearest relay point.




V - Conditions for a sale cancellation by our services

You have a legal withdrawal period of 14 days to cancel an order. If you cancel an order after the packages have been shipped, the bottles must be returned in the same condition at the buyer's expense.

We reserve the right to cancel a sale in the following cases (full and immediate reimbursement):

  1. Typing error when entering a price.
  2. Payment fraud
  3. Minor (under 18 in France) and uncertain identity.
  4. Product out of stock or not updated on the site (indicated in stock) but no longer in our actual stock.
  5. Error in the allocation of loyalty points exceeding 10%

We keep the right to cancel a delivery in a non-conforming geographical area, or which would use erroneous information.

VI - Loyalty points

Loyalty points are calculated by our system more or less exactly depending on the amounts and discounts.

  1. 1- The configuration must normally give 100 loyalty points for 100 euros excluding tax spent, excluding shipping costs.
  2. 2- If there is a difference in your favor or against you for a value exceeding 10% of the value quoted in V-1. you must notify us so that we can rectify the situation.
  3. 3- In the event of an error not reported for a value greater than 10%, we reserve the right to cancel an order and manually settle your loyalty points.
  4. 4- 100 Loyalty Points correspond to 4 € HT excluding shipping costs of an order with a possible adjustment of plus or minus 10 percent of this value.
